Your ability to sponsor a relative for an immigrant visa, or bring them to the US with you, depends on a number of factors, including your familial relationship and your relative’s age and marital status. These factors will also determine how long your relative will have to wait for an immigrant visa.
Family members may be sponsored under one of the four “preferences” or a special category called “immediate relatives.”
Immediate relatives are the spouses and minor children of US citizens or the parents of adult US citizens. Immediate relative petitions are not subject to numerical limitations and are processed much faster than any other family-based category.
The following preference categories apply to family members who are not immediate relatives:
- First preference: Unmarried, adult sons and daughters of US citizens
- Second preference: Spouses and unmarried children of permanent residents and unmarried adult sons and daughters
- Third preference: Married sons and daughters of US citizens
- Fourth preference: Brothers and sisters of adult US citizens
